PUBLIC OFFER AGREEMENT
for the purchase and sale of goods in an online store
1. General provisions
1.1. This agreement is an official and public offer by individual entrepreneur Iryna Oleksandrivna Baklazhkova (hereinafter referred to as the “Seller”) to conclude an agreement for the sale and purchase of goods presented on the website (hereinafter referred to as the ‘Website’) with any individual or legal entity (hereinafter referred to as the “Buyer”).
1.2. In accordance with Articles 633 and 641 of the Civil Code of Ukraine, this document is a public offer, and if its terms are accepted (by placing an order on the Website or by other means), the Buyer undertakes to comply with the terms of this Agreement.
1.3. Placing an order by the Buyer confirms their familiarity with this Agreement and its full acceptance.
2. Subject of the Agreement
2.1. The Seller undertakes to transfer to the Buyer's ownership goods for educational, developmental, and gaming purposes (author's manuals, games, reusable notebooks, etc.), and the Buyer undertakes to accept and pay for them under the terms of this Agreement.
2.2. The characteristics, prices, availability, and images of the goods are provided in the relevant descriptions on the Website.
3. Ordering procedure
3.1. The Buyer places an order through the Website or by contacting the Seller by any available means.
3.2. To place an order, the Buyer undertakes to provide accurate information: full name, delivery address, contact phone number, email (if necessary).
3.3. The Seller reserves the right to refuse to fulfill the order if the goods are out of stock or the contact details provided are incorrect.
4. Payment for goods
4.1. For the convenience of the Buyer, the following payment methods are available:
- full prepayment to the Seller's card account or current account;
- partial prepayment in the amount of UAH 200, the remaining amount is paid after receiving the order.4.2. Prepayment guarantees the reservation of goods and covers shipping costs in case the Buyer refuses the order. 4.3. After confirming the payment, the Seller sends a notification about the shipment of the order. 4.4. All payments are made securely, in accordance with the current legislation of Ukraine.
5. Delivery of goods
5.1. Delivery in Ukraine is carried out by Nova Poshta and Ukrposhta with the option of receiving the order at a branch or by courier.
5.2. Delivery time in Ukraine is 2 to 7 business days, depending on the region and the work of the postal services.
5.3. International delivery is carried out to countries in Europe and around the world via Nova Poshta or Ukrposhta. The cost and terms are determined individually according to the carriers' tariffs.
5.4. The risk of accidental loss or damage to the goods passes to the Buyer from the moment of receipt from the carrier.
6. Exchange and return of goods
6.1. The Seller cares about the quality of the products and guarantees their proper condition.
6.2. If the Buyer receives goods with manufacturing defects or damage during delivery, the Seller will exchange or refund the goods.
6.3. To do this, the Buyer must notify the Seller of the defect within 14 calendar days from the moment of receipt of the goods and provide photo/video confirmation.
6.4. Exchange or refund is possible only if the goods are in good condition, complete, and show no signs of use.
6.5. In case of a defect or error on the part of the Seller, the cost of return delivery shall be borne by the Seller. If the return is for other reasons (for example, a change in the Buyer's decision), delivery shall be at the Buyer's expense.
6.6. Refunds will be made within 7 business days from the date the Seller receives the returned goods.
7. Copyright
7.1. All educational materials, author's manuals, games, and reusable workbooks sold by the Seller are intellectual property and protected by copyright.
7.2. Copying, reproduction, distribution, or other use of the materials without the Seller's written permission is prohibited.
8. Liability of the parties
8.1. The Seller is not responsible for delays in delivery due to reasons dependent on carriers or force majeure circumstances.
8.2. The Buyer is responsible for the accuracy of the information provided when placing an order.
9. Final provisions
9.1. This agreement shall remain in force until the parties have fulfilled their obligations in full.
9.2. The Seller has the right to unilaterally change the terms of this Agreement by publishing an updated version on the Website.
9.3. All disputes shall be resolved through negotiations, and if no agreement is reached, in court in accordance with the current legislation of Ukraine.
